Terms & Conditions of Sale
1. About Us
These Terms & Conditions apply to all purchases made through the Adelaide Pilates website.
In these Terms, "Adelaide Pilates", "we", "our" and "us" means Muve Tech Pty Ltd trading as Adelaide Pilates.
By placing an order with Adelaide Pilates, you agree to these Terms & Conditions.
2. Pricing and Payment
All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated.
Payment must be received in full before goods are dispatched unless otherwise agreed in writing.
We reserve the right to correct pricing errors or withdraw products from sale at any time prior to accepting your order.
If an order cannot be fulfilled for any reason, any payment received will be refunded in full.
3. Order Acceptance
Submitting an order does not constitute acceptance of that order.
We reserve the right to accept or decline any order, including where:
a product is unavailable;
pricing or product information is incorrect;
payment cannot be authorised; or
we reasonably suspect fraudulent activity.
If an order is declined after payment has been received, a full refund will be issued.
4. Order Cancellations & Change of Mind
Orders may only be cancelled with our written approval.
Under the Australian Consumer Law, customers are not entitled to a refund, replacement or credit simply because they have changed their mind.
If Adelaide Pilates agrees to a cancellation or change-of-mind refund, it is at our discretion and may be subject to:
deduction of any non-refundable merchant processing fees, payment gateway charges or other direct transaction costs incurred;
freight or delivery costs already incurred; and
the goods being returned unused, in their original packaging and in saleable condition.
Special order, custom-made or made-to-order products cannot be cancelled or returned once production, procurement or manufacture has commenced.
Nothing in this clause limits your rights under the Australian Consumer Law.
5. Title and Risk
Ownership of goods passes to you once payment has been received in full.
Risk in the goods passes to you upon delivery to the nominated delivery address, including where Authority to Leave has been provided.
6. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
7. Product Information
We make every effort to ensure product descriptions, specifications, photographs and pricing are accurate.
Occasionally, colours, finishes, timber grain, upholstery and other natural materials may vary slightly from photographs or display samples.
Specifications and product information may change without notice as manufacturers update their products.
8. Limitation of Liability
To the extent permitted by law, Adelaide Pilates is not liable for any indirect, incidental or consequential loss arising from the purchase or use of our products.
Our total liability for any claim relating to goods supplied by Adelaide Pilates will not exceed the purchase price of the relevant product, except where otherwise required under the Australian Consumer Law.
9. Privacy
Any personal information collected through our website is handled in accordance with our Privacy Policy.
